Introduction

Welcome to Nextil ("Nextil", "we", "us", or "our"), a platform that connects service providers and customers for scheduling and managing appointments.

These Terms of Service ("Terms") govern your use of our website, web application, mobile applications, and related services (collectively, the "Service").

By creating an account or using the Service, you agree to these Terms. If you do not agree, you may not use Nextil.

Accounts and Access

To book or provide services, you must create an account. You agree to:

• Provide accurate and up-to-date information.
• Maintain the confidentiality of your login credentials.
• Accept responsibility for all activity under your account.

You must be at least 18 years old to create an account and use Nextil.

Third-Party Sign-In: You may create an account or sign in using Google Sign-In or Apple Sign-In. By using these authentication methods, you agree to be bound by the respective provider's terms of service and privacy policies. You are responsible for maintaining the security of your third-party account credentials.

If you suspect unauthorized access, notify us immediately.

Roles and Responsibilities

Customers may browse and book available services.

Providers are responsible for maintaining accurate service listings, schedules, and pricing.

Nextil acts solely as a technology platform and is not a party to any transaction between customers and providers.

Bookings, Subscriptions, and Cancellations

Bookings: A booking represents a request between a customer and a provider. Providers have the right to accept or reject bookings based on their availability.

Subscriptions: All subscription purchases and payments are processed exclusively through Apple's App Store billing system. Nextil does not directly process, store, or have access to your payment information. Refunds, billing disputes, and subscription management are handled by Apple in accordance with their App Store Terms and Conditions.

Cancellations & Rescheduling: Each provider may define their own policy. Customers should review these before confirming a booking. Failure to comply may result in restrictions on future bookings.

User Content and Reviews

Users may submit reviews, feedback, or profile content. By doing so, you grant Nextil a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content for operating and promoting the Service.

You are responsible for ensuring that your content does not infringe on others’ rights or violate any laws.

Prohibited Activities

You agree not to use the Service to:

1. Engage in fraud, spam, or abusive behavior.
2. Collect or harvest data without consent.
3. Interfere with or disrupt other users, providers, or system operations.
4. Impersonate another person or entity.

Violations may result in suspension or termination of your account.

Privacy and Data Use

Your personal information is handled in accordance with our Privacy Policy.

We use third-party tools and services to operate the Service:

• Supabase for authentication, database, and data storage
• Google Sign-In and Apple Sign-In for OAuth authentication
• Google Analytics for usage analytics
• Google AdMob for displaying advertisements in our mobile app
• Mapbox for location services and navigation to service provider locations
• hCaptcha for spam prevention and security
• Apple App Store for subscription billing

By using Nextil, you consent to our data practices and the use of these third-party services as described in our Privacy Policy.

Advertising

Our mobile application displays advertisements through Google AdMob. These ads help us provide the Service at low or no cost to users.

By using the mobile app, you acknowledge that:

• Third-party advertisers may collect data as described in their privacy policies
• Ad content is controlled by advertisers, not Nextil
• We are not responsible for the content or accuracy of third-party advertisements

Intellectual Property

The Service, including its design, software, text, images, and other content (excluding user-generated content), is owned by Nextil and protected by intellectual property laws.

You may not:

• Copy, modify, or distribute our content without permission

• Remove or alter any copyright, trademark, or proprietary notices

User-generated content (profiles, reviews, photos) remains your property, but you grant us a license to use it as described in the User Content section.

Disclaimers and Limitations of Liability

Nextil provides the Service on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee uninterrupted operation or that the Service will meet your specific needs.

Nextil is not responsible for the acts, errors, or omissions of service providers or customers.

To the fullest extent permitted by law, we disclaim all warranties and liability for indirect, incidental, or consequential damages.

Indemnification

You agree to indemnify and hold harmless Nextil and its affiliates from any claims, damages, losses, or expenses arising out of:

• Your use of the Service.
• Your content or submissions.
• Your violation of these Terms.

Modifications to the Service or Terms

Nextil may update or modify these Terms at any time.

If changes are significant, we will provide notice via email, in-app message, or by updating the “Last Updated” date.

Continued use after such changes means you accept the revised Terms.

Termination

We may suspend or terminate your access if you:

• Violate these Terms.
• Misuse the Service.
• Engage in fraudulent or harmful activity.

You may delete your account at any time. Upon deletion, we will remove your personal data subject to applicable retention laws.

Governing Law

These Terms are governed by the laws of the United States and the state in which Nextil operates, without regard to conflict of law principles.
